If you do not agree to these Terms of Use, you may not use the Services. By using the Services, you signify your acceptance to the Terms of Use and Privacy Policy (hereby incorporated by reference herein), which take effect on the date you start using the Services and create a legally binding arrangement to abide by the same.
We reserve the right to change the Terms of Use and Privacy Policy at any time without notice, by posting changes on the Website. You shall be liable to update yourself of such changes by accessing the changes on the Website. You shall be responsible for regularly reviewing the Terms of Use and the Privacy Policy and noting any changes made. Your continued usage of the Services after any change is posted constitutes your acceptance of the amended Terms of Use and Privacy Policy.

How the Service Works
Baagdi Solutions is a web development and design service provider offering an online platform to place your orders for services such as web development, web designing, SEO promotions, graphics designing, UI/UX design, frontend, and backend development. We will execute your order based on the requirements you provide.
Account Registration or Use of the Services
You may access the Services without registering or signing in on the website and directly as a guest.
By filling out any form on the Baagdi Solutions website, you are allowing us to use your contact information for marketing purposes (related to Baagdi Solutions only) for sending promotional emails and messages.
If you call us, you are allowing us to use your phone number for marketing purposes (related to Baagdi Solutions only) to send you promotional messages via SMS or WhatsApp.
Currently, we do not have any signup or login system using third-party services. However, if we start such a feature, by signing up or logging in via those third-party services, you represent that you are entitled to disclose your third-party account login information to us and/or grant us access to your third-party account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable third-party account and without obligating us to pay any fees or making us subject to any usage limitations imposed by such third-party service providers.
By granting us access to any third-party accounts, you understand that we will access, make available, and store (if applicable) any content or information that you have provided to and stored in your third-party account (“SNS Content”) so that it is available on and through the Services via your account.
Unless otherwise specified in these Terms of Use, all SNS Content, if any, will be considered to be your content for all purposes of these Terms.
Order Placement and Financial Terms
The Services allow you to place service orders, and we will, subject to the terms and conditions set out herein, deliver the same to you. You understand that any order you place shall be subject to the restrictions and limitations set out in these Terms of Use, including, but not limited to, service availability and serviceable areas.
As a general rule, all service orders are treated as confirmed. However, upon your successful completion of booking an order, we may call you on the telephone or mobile number provided to confirm the details of the order, the price to be paid, and the estimated delivery time. For this purpose, you will be required to share certain information with us, including but not limited to (i) first and last name, (ii) mobile number, (iii) service address, and (iv) email address. It shall be your sole responsibility to bring any incorrect details to our attention.
In addition to the foregoing, we may also contact you by phone and/or email to inform and confirm any change in the order, due to availability or unavailability or change in the price of the order. At this time, any change or confirmation of the order shall be treated as final, and you will receive an email confirming the change in order. It is clarified that in the event you are unavailable on the phone at the time we are confirming the order, we will cancel your order, and the provisions of the cancellation and refund policy below shall be applicable.
You can pay by credit card, debit card, or net banking at the time of booking an order, or you can pay by credit or debit card or cash at the time of delivery.
You acknowledge and agree that we act as the Vendor’s payment agent for the limited purpose of accepting payments from you on behalf of the Vendor. Upon your payment of amounts to us, which are due to the Vendor, your payment obligation to the Vendor for such amounts is completed, and we are responsible for remitting such amounts to the Vendor. You shall not, under any circumstances whatsoever, make any payment directly to the Vendor.
You agree to pay us for the total amount for any booking made. We will collect the total amount in accordance with the terms and conditions of these Terms of Use and the pricing terms set forth in the applicable menu listing for the particular Vendor. Please note that we cannot control any amount that may be charged to you by your bank related to our collection of the total amount, and we disclaim all liability in this regard.
In connection with your order, you will be asked to provide customary billing information such as name, billing address, and credit card information either to us or our third-party payment processor. You agree to pay us for any confirmed bookings in accordance with these Terms by one of the methods described on the Services, e.g., by a credit card. You hereby authorize the collection of such amounts by charging the credit card provided as part of requesting the booking, either directly by us or indirectly, via a third-party online payment processor or by one of the payment methods described on the Services. If you are directed to our third-party payment processor, you may be subject to terms and conditions governing the use of that third-party’s service and that third-party’s personal information collection practices. Please review such terms and conditions and privacy policy before using the services. Once your confirmed booking transaction is complete, you will receive a confirmation email summarizing your confirmed booking.
Terms of Service
You agree and acknowledge that we shall not be responsible for:
The services provided by the Vendor, including but not limited to, delivering service orders suiting your requirements and needs;
The Vendor’s services not being up to your expectations or leading to any loss, harm, or damage to you;
The details of the products and price list available on the Services are based on the information provided by the Vendors, and we shall not be responsible for any change or cancellation or unavailability.
You may not be able to avail of our Services if your location is outside our current serviceable areas. We will keep you informed of the same at the time of confirming your order booking.
You understand that delivery periods quoted to you at the time of confirming the order are an approximate estimate and may vary. We will not be responsible for any delay in the delivery of your order.
Your order will only be delivered to the address designated by you at the time of placing the order on the Services. We reserve the right to cancel the order, in our sole discretion, in the event of any change to the place of delivery, and you shall not be entitled to any refund for the same. Delivery in the event of change of the delivery location shall be at our sole discretion.
You shall undertake to provide adequate directions, information, and authorizations to accept delivery. In the event of any failure to accept delivery, failure to deliver within the estimated time due to your failure to provide appropriate instructions or authorizations, then such goods shall be deemed to have been delivered to you, and all risk and responsibility in relation to such goods shall pass to you, and you shall not be entitled to any refund for the same. Our decision in relation to this shall be final and binding.
You understand that our liability ends once your order has been delivered to you.
Services Provided
You confirm that we shall not be responsible for any deficiency in payment of consideration payable towards the goods purchased from the Services.
Each purchase on the Service shall contain necessary instructions to redeem the Services. The terms of the services shall be governed by these Terms of Use and any other terms as set out in such a document confirming such a sale of service. You shall not be entitled to receive any credit, refund, or cashback for the value of the goods sold if you fail to redeem the goods within the expiry date or in accordance with the terms therein.
You agree and acknowledge that neither we nor the Vendor shall be liable in the event of you failing to adhere to the Terms of Use.
You might be required to provide your credit or debit card details to the approved payment gateways while making the payment. In this regard, you agree to provide correct and accurate credit/debit card details to the approved payment gateways for availing the Services. You shall not use the credit/debit card which is not lawfully owned by you, i.e., in any transaction, you must use your own credit/debit card. The information provided by you will not be utilized or shared with any Third Party unless required in relation to fraud verification or by law, regulation, or court order. You will be solely responsible for the security and confidentiality of your credit/debit card details. We expressly disclaim all liabilities that may arise as a consequence of any unauthorized use of your credit/debit card.
We do not offer any refunds against goods already purchased from the Services unless an error that is directly attributable to us has occurred during the purchase of such product or services.
We constantly strive to provide you with accurate information on the Services. However, in the event of an error, we may, in our sole discretion, contact you with further instructions.
If you use the Services, you do so at your own risk.
Intellectual Property
We grant you a personal, limited, non-exclusive, and non-transferable right to access and use the Services. All intellectual property in the Services, in the underlying software, and all information provided on the Services is owned by or licensed to us. You have no right, title, or interest in any such intellectual property except as expressly provided in these Terms.
User Conduct
You agree to use the Services only for lawful purposes. You shall not post or transmit through the Services any material that violates or infringes in any way upon the rights of others, is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable, or that encourages conduct that would constitute a criminal offense, gives rise to civil liability, or otherwise violates any law.
Disclaimer of Warranties and Liability
You expressly understand and agree that, to the maximum extent permitted by applicable law, the Services and other materials are provided by Baagdi Solutions on an “as is” basis without warranty of any kind, express, implied, statutory, or otherwise, including the implied warranties of title, non-infringement, merchantability, or fitness for a particular purpose.
Without limiting the foregoing, Baagdi Solutions makes no warranty that (i) the Services or the other materials will meet your requirements or your use of the Services will be uninterrupted, timely, secure, or error-free; (ii) the results that may be obtained from the use of the Services will be effective, accurate, or reliable; (iii) the quality of the Services or other materials will meet your expectations; or that (iv) any errors or defects in the Services or other materials will be corrected. No advice or information, whether oral or written, obtained by you from Baagdi Solutions or through or from the use of the Services shall create any warranty not expressly stated in the terms of use.
To the maximum extent permitted by applicable law, Baagdi Solutions will have no liability related to user content arising under intellectual property rights, libel, privacy, publicity, obscenity, or other laws. Baagdi Solutions also disclaims all liability with respect to the misuse, loss, modification, or unavailability of any user content.
Baagdi Solutions will not be liable for any loss that you may incur as a consequence of unauthorized use of your account or account information in connection with the Services, either with or without your knowledge.
Baagdi Solutions has endeavored to ensure that all the information on the Website is correct, but Baagdi Solutions neither warrants nor makes any representations regarding the quality, accuracy, or completeness of any data, information, product, or service. Baagdi Solutions shall not be responsible for the delay or inability to use the Services or related functionalities, the provision of or failure to provide functionalities, or for any information, software, products, functionalities, and related graphics obtained through the Services or otherwise arising out of the use of the Services, whether based on contract, tort, negligence, strict liability or otherwise. Further, Baagdi Solutions shall not be held responsible for non-availability of the Services during periodic maintenance operations or any unplanned suspension of access to the Services that may occur due to technical reasons or for any reason beyond Baagdi Solutions’ control. You understand and agree that any material or data downloaded or otherwise obtained through the Services is done entirely at your own discretion and risk, and you will be solely responsible for any damage to your computer systems or loss of data that results from the download of such material or data. Baagdi Solutions is not responsible for any typographical error leading to an invalid coupon. Baagdi Solutions accepts no liability for any errors or omissions, with respect to any information provided to you.
Limitation of Liability
To the maximum extent permitted by applicable law, Baagdi Solutions, its affiliates, officers, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use of or inability to use the Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Services; and/or (vi) the defamatory, offensive, or illegal conduct of any third party. In no event shall Baagdi Solutions, its affiliates, officers, employees, agents, suppliers, or licensors be liable for any claims, proceedings, liabilities, obligations, damages, losses, or costs in an amount exceeding the amount you paid to Baagdi Solutions hereunder or $100.00, whichever is greater.
Indemnity
You agree to indemnify, defend, and hold harmless Baagdi Solutions, its directors, officers, employees, consultants, and agents from and against any and all third-party claims, damages, losses, costs (including, but not limited to, reasonable attorneys’ fees) and other expenses that arise directly or indirectly out of or from (i) your breach of these Terms of Use; and/or (ii) your activities in connection with the Services.
Miscellaneous
These Terms of Use are governed by and construed in accordance with the laws of the State of Rajasthan, India, without regard to its principles of conflicts of law. You agree to submit to the personal and exclusive jurisdiction of the courts located in Jaipur, Rajasthan. You agree that, if you are a consumer, the laws of the country in which you reside will apply to any claim or cause of action you may have against us, and you agree to submit to the non-exclusive jurisdiction of the courts of that country.
You may not use the Services if you are a resident of a country embargoed by the Government of India, or are a foreign person or entity blocked or denied by the Government of India.
